Georgia Arrest Records and Booking Photo Law

Georgia arrest records are kept by the sheriffs and jails of the 159 Georgia counties, and the cases that follow are kept by the county courts. Georgia law makes commercial websites remove a booking photo free of charge in set circumstances, and we treat Georgia as a restricted state. This page lists the official Georgia sources and explains the law.

How arrest and booking records are kept in Georgia

An arrest in Georgia is booked by the county sheriff or the city police department, and the arrest record itself is open under the Georgia Open Records Act. Booking photos are handled differently, and we treat Georgia as a restricted state. Criminal cases are kept by the clerk of the superior court or state court of the county. People sentenced to prison are recorded by the Georgia Department of Corrections.

An arrest is not a conviction. Charges may have been dropped, dismissed or resulted in acquittal.
