How arrest and booking records are kept in Texas

Arrest records in Texas are created by the arresting agency and the county jail that books the person. They are generally released under Chapter 552 of the Texas Government Code, although an agency may withhold some law enforcement records while an investigation is open. Criminal cases are filed with the district clerk or the county clerk of each county. People sentenced to state prison or state jail are recorded by the Texas Department of Criminal Justice.

An arrest is not a conviction. Charges may have been dropped, dismissed or resulted in acquittal.
